These Terms of Service ("Terms") govern your use of the Axintech mobile app and website (the "Service"), operated by Axintech. By creating an account or using the Service, you agree to these Terms.
1. Eligibility and Accounts
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
2. The Service
Axintech lets you locate charging stations, plan routes, start and stop charging sessions, and pay via an in-app wallet. Charger availability, pricing, and status information is provided on a best-effort basis and may not always be accurate or up to date.
3. Wallet, Payments, and Pricing
- Your wallet balance is funded through supported payment methods and used to pay for charging sessions, subject to applicable fees and taxes.
- Pricing may vary by charger, time of day, and site operator, and is displayed before you start a session where possible.
- Wallet top-ups are generally non-refundable except as required by law or as we determine in our discretion.
- Vouchers and reward points are subject to their own terms, expiry, and eligibility rules, and have no cash value.
4. Charging Sessions
You are responsible for safely connecting and disconnecting your vehicle and for complying with any posted instructions at a charging site. Chargers are owned and maintained by third-party site operators; Axintech facilitates discovery, session initiation, and payment, but is not the manufacturer or physical operator of charging hardware.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Interfere with, damage, or attempt unauthorized access to chargers, the app, or our systems.
- Misuse vouchers, promotions, or the wallet system, including fraudulent top-ups or chargebacks.
- Share your account credentials or allow unauthorized use of your account.
6. Third-Party Services
The Service integrates third-party mapping, navigation, and payment providers. Your use of those features may also be subject to the applicable third party's terms and privacy practices.
7. Disclaimers
The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that chargers shown as available will be functional, or that the Service will be uninterrupted or error-free.
8. Limitation of Liability
To the maximum extent permitted by law, Axintech shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service, including charger malfunctions, delays, or vehicle-related issues at third-party charging sites.
9. Termination
We may suspend or terminate your account for violation of these Terms, suspected fraud, or misuse of the Service. You may stop using the Service and request account closure at any time.
10. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict of law principles.
